Terms of Service

Last updated: July 26, 2026

1. Who We Are

These Terms are between you and Devjoy LTD, a company registered in England and Wales, whose registered office is at 128 City Road, London, United Kingdom ("we", "our", "us"). We trade as "CallSpark".

By accessing or using our website and services at https://callspark.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.

You can contact us at https://callspark.app/contact.

2. Description of the Service

CallSpark allows users to make and receive phone calls directly from their web browser and mobile app, including international calling. There are no contracts, no monthly fees, and no hidden charges. Users purchase call credits ("Credits") which are used to access the Service.

3. Eligibility

By using CallSpark, you confirm that you:

Are at least 18 years old, and

Have the legal capacity to enter into a binding agreement.

4. User Accounts

To use certain features of the Service, you may be required to create an account. You agree to:

Provide accurate and complete information

Keep your account credentials secure

Be responsible for all activity under your account

5. Credits

5.1 Credits are a prepaid balance redeemable only against communications services supplied by us. Credits are not money, not a deposit, not electronic money, and not a stored-value or payment instrument. They carry no right to interest and are not held on trust for you.

5.2 Credits are personal to your account. They may not be transferred, assigned, sold, exchanged, or redeemed for cash, except where we are required to do so by law or as expressly set out in Section 6 (Payments and Refunds) or Section 11 (Effect of Suspension or Termination on Credits).

5.3 Credits are consumed at the rates published within the Service at the time a call is placed. Rates vary by destination and may change. It is your responsibility to check the applicable rate before placing a call.

5.4 We may set a maximum Credit balance, a maximum top-up amount, or a maximum rate of spend on any account, and may decline or limit any top-up.

6. Payments and Refunds

6.1 All payments are final, except as set out in this Section 6 or where a refund is required by law.

6.2 Unused purchases. If you have not used any of the Credits from a purchase, you may request a refund of that purchase through our contact page.

6.3 Used purchases. Once any of the Credits from a purchase have been used, that purchase is not refundable.

6.4 Consumer cancellation rights. If you are a consumer, you have a statutory right to cancel a purchase within 14 days of the date of purchase. Where you cancel within that period and have used part of the Credits, we will refund the amount attributable to the Credits you have not used, and may deduct an amount proportionate to the Services already supplied to you.

6.5 Credits purchased for, or subsequently used or attempted to be used for, calls to destinations that are not supported or are restricted under these Terms (including any Restricted Jurisdiction described in Section 13) are not eligible for a refund. It is your responsibility to confirm that a destination is supported before purchasing Credits.

6.6 Refunds are made only to the original payment method. We will not refund to a different payment method, to a different cardholder, or to any third party.

6.7 All payments are processed securely through third-party payment providers. We do not store full payment card details. You agree to pay all applicable fees and taxes related to your purchases.

6.8 Nothing in this Section affects your statutory rights.

Refund requests must be submitted through our contact page: https://callspark.app/contact

7. Payment Authorisation and Card Security

7.1 You warrant that, for every payment method you use with the Service:

(a) you are the cardholder or an authorised user of that payment method;

(b) you have the express permission of the payment method holder to use it for the amounts charged; and

(c) the payment and billing information you provide is accurate, current and complete.

7.2 You authorise us and our payment processors to charge your payment method for all amounts due, including top-ups you initiate and any automatic top-ups you have enabled, and to perform verification checks (including authorisation holds and reversals of those holds) on that payment method.

7.3 You must not use any payment method you are not authorised to use. Using a lost, stolen, misappropriated, or otherwise unauthorised payment method is a serious breach of these Terms and may constitute a criminal offence. We report suspected payment fraud to our payment processors, to the card schemes, and where appropriate to law enforcement, and we co-operate with their investigations.

7.4 We may require identity verification, Strong Customer Authentication (including 3-D Secure), or further evidence that you are entitled to use a payment method before accepting a payment, releasing Credits, or permitting calling. We may decline any payment at our discretion.

7.5 If you become aware that a payment method registered on your account has been compromised, you must notify us immediately via our contact page and remove it from your account.

8. Chargebacks and Payment Disputes

8.1 If you believe a charge is incorrect, please contact us first. Most billing issues are resolved faster and more fully this way than through a bank dispute.

8.2 Where a chargeback, reversal, or payment dispute is raised in respect of a payment made to us, we may immediately:

(a) suspend your account and your ability to place calls;

(b) suspend, and where Section 11.2 applies void, the Credits funded by the disputed payment; and

(c) decline further payments from that payment method.

8.3 Where a chargeback is withdrawn or resolved in our favour, or where it was raised in respect of services that you authorised and received, you remain liable to us for the disputed amount, together with any fee levied on us by our payment processor or the relevant card scheme in connection with that dispute and our reasonable administrative costs of responding to it.

8.4 Nothing in this Section limits or affects any statutory right you have to dispute an unauthorised or incorrect transaction with your card issuer or payment service provider.

9. Acceptable Use

You agree not to use CallSpark:

For unlawful, fraudulent, or abusive purposes

To harass, threaten, or deceive others

To violate any applicable laws or regulations

To interfere with or disrupt the Service

10. Fraud Prevention, Suspension and Termination

10.1 We operate automated and manual controls to detect fraud, payment abuse, and misuse of the Service.

10.2 We may decline or reverse a top-up, place an account under review, restrict calling, suspend an account, or terminate an account and these Terms, where we reasonably suspect any of the following:

(a) use of a payment method without the holder's authority;

(b) chargeback abuse, refund abuse, or repeated disputed payments;

(c) the operation of multiple accounts to evade limits, pricing, verification or a prior suspension;

(d) use of the Service for fraud, deception, scam calling, unlawful call spoofing, harassment, or any unlawful purpose;

(e) circumvention of the Restricted Jurisdiction controls in Section 13, or of sanctions, export control, or telecommunications regulation;

(f) any other material breach of these Terms.

10.3 We will act proportionately to the matter concerned. Where we suspend or terminate your account we will notify you, and you may challenge that decision by contacting us within 14 days of the date we notify you. We will review your challenge and respond within a reasonable period. We may decline to give reasons, or to notify you in advance, where doing so would be unlawful, would prejudice the detection or prevention of fraud, or would prejudice an investigation by us or by a competent authority.

10.4 Suspension does not relieve you of liability for amounts already due.

11. Effect of Suspension or Termination on Credits

11.1 Where we terminate or suspend your account for a reason set out in Section 10.2, we may set off against your remaining Credit balance:

(a) any amount charged back, reversed, or refunded to a payment method in respect of your account;

(b) any fee levied on us by a payment processor or card scheme in connection with those amounts;

(c) the value, at our published rates, of any Services obtained through or in connection with the breach; and

(d) our reasonable costs of investigating and recovering the above.

11.2 Credits funded by a payment that was unauthorised, fraudulent, charged back, or reversed are void from the outset and confer no rights. They are not refundable to you, and any Services already obtained using them remain chargeable to you.

11.3 Any Credit balance remaining after the application of Section 11.1 is not forfeited. We will refund it to the original payment method on written request made within twelve (12) months of termination, subject to any legal or regulatory obligation preventing us from doing so, and subject to our completing any identity or entitlement verification we reasonably require.

11.4 Where you close your account, or we terminate for convenience or for any reason not within Section 10.2, unused Credits are dealt with under Section 6.

12. Set-Off and Recovery

12.1 We may set off any amount you owe us under these Terms against any amount we owe you, including any Credit balance.

12.2 If you are a business user, you must pay all sums due without set-off, counterclaim, deduction or withholding.

13. Sanctioned and High-Risk Jurisdictions

CallSpark does not provide calling services to, from, or within Cuba, Iran, North Korea, Syria, or the regions of Crimea, Donetsk, and Luhansk (collectively, "Restricted Jurisdictions"). You agree not to use the Service to initiate, route, or receive calls that originate from, terminate in, or otherwise directly or indirectly involve any Restricted Jurisdiction or any person or entity subject to applicable sanctions or export controls.

We may block, cancel, or refuse any use of the Service that we reasonably believe involves a Restricted Jurisdiction or violates sanctions or other regulatory requirements, and we may suspend or close accounts that do so.

14. Data Collection & Privacy

We collect the following personal information:

Name

Payment information

Business information (if provided)

We also collect non-personal data such as cookies for website functionality and analytics.

15. Third-Party Services

The Service may rely on third-party providers (e.g., telephony or payment services). We are not responsible for interruptions, errors, or issues caused by third-party services beyond our reasonable control.

16. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time.

17. Limitation of Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. If you are a consumer, nothing in these Terms affects your statutory rights.

Subject to the paragraph above, and to the maximum extent permitted by law, we shall not be liable for:

Indirect, incidental, or consequential damages

Loss of data, profits, or business

Service interruptions or failures

We are not liable for any loss you suffer as a result of our exercising a right under Section 8 (Chargebacks and Payment Disputes), Section 10 (Fraud Prevention, Suspension and Termination), or Section 11 (Effect of Suspension or Termination on Credits), where we have acted reasonably and in accordance with those Sections.

Subject to the first paragraph of this Section, our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

18. Indemnification

If you are a business user, you agree to indemnify and hold us harmless from any claim, loss, fine, cost or expense arising from: your use of the Service; your violation of these Terms; your use of a payment method you were not authorised to use; any chargeback or reversal arising from your acts or omissions; and any use of the Service by you in breach of Section 10.2.

19. Changes to These Terms

19.1 We may change these Terms. Where a change is material and affects you, we will give you at least 14 days' notice by email or through the Service before it takes effect.

19.2 If you do not accept a material change, you may close your account before it takes effect and request a refund of unused Credits under Section 6.

19.3 Minor changes that do not affect your rights (for example correcting typographical errors or clarifying wording) take effect on posting.

20. Governing Law and Jurisdiction

20.1 These Terms and any dispute arising out of them are governed by the laws of England and Wales.

20.2 The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
